1. Website and Product Information
The website describes Abhikalan Technologies, AbhiPOSS, services, pricing, documentation, and demo content. Product information, feature descriptions, screenshots, roadmap items, supported hardware, and pricing references are indicative until confirmed in a written order, invoice, subscription, or signed agreement.
2. Software Licence
AbhiPOSS is licensed, not sold. A valid licence, subscription, or commercial authorization is required for production use. The customer must not bypass activation, tamper with licence checks, reverse engineer the software, remove branding or notices, resell access without authorization, or use the software outside the agreed business scope.
3. Customer Agreement and Commercial Terms
Final commercial terms may include plan, billing cycle, renewal, expiry grace period, support scope, implementation scope, training, customization, hardware responsibilities, taxes, cancellation terms, and termination rights. Where there is a conflict, the signed agreement, order form, invoice, or subscription terms control.
4. Customer Responsibilities
The customer is responsible for correct business configuration, tax setup, product/menu data, staff access, passwords, device security, operating system maintenance, printer/network readiness, local backups, and lawful use of the software. The customer should verify tax reports, invoices, and business records with its accountant or advisor before statutory filing.
5. Offline, Local, and Customer-Controlled Data
AbhiPOSS can be deployed in offline-first and local environments. In such deployments, outlet data remains under customer control on the customer's device, server, or local network. Unless a managed backup, sync, hosted, or remote support service is enabled, Abhikalan does not automatically possess that business data and cannot guarantee recovery after deletion, corruption, device failure, theft, or operating system damage.
6. Managed Services, Backup, and Remote Support
If the customer chooses managed backup, sync, hosting, or remote support, the applicable plan or agreement should define access, retention, restore process, recovery expectations, support windows, and exclusions. Remote support should be used only with customer authorization and may require temporary access to configuration, logs, or business data needed to resolve the support case.
7. Security
Abhikalan applies reasonable controls to systems under its control. The customer is responsible for local device protection, physical security, network access, user permissions, credential discipline, and restricting admin access. No software, network, hardware, or backup process can be guaranteed to be completely secure or uninterrupted.
8. Support Scope
Support may cover product guidance, configuration help, licence activation, troubleshooting, updates, and agreed implementation assistance. Support does not automatically include third-party printer repair, internet failure, local network administration, operating system repair, device replacement, custom development, accounting advice, or tax filing unless expressly agreed.
9. Payments, Renewal, Cancellation, and Refunds
Monthly, annual, trial, renewal, cancellation, and refund terms depend on the selected plan and invoice. Paid periods generally cover access and support for the selected term. Refund eligibility, cancellation timing, downgrade rules, and data handover obligations should be reviewed before purchase and may be governed by the signed agreement or invoice terms.
10. GST, Tax, and Compliance Outputs
AbhiPOSS may generate receipts, invoices, GST summaries, sales reports, exports, and other business records based on customer-entered data and settings. These tools support operations and accounting review, but the customer remains responsible for verifying rates, exemptions, classifications, filings, and professional advice.
11. Limitation of Liability
To the maximum extent permitted by law and subject to the final signed agreement, Abhikalan Technologies is not liable for indirect, incidental, special, punitive, or consequential losses, including loss of profit, business interruption, loss of data, hardware failure, tax penalties, or third-party service disruption. Any direct liability is limited as stated in the applicable agreement.
12. Governing Law
These website terms are governed by the laws of India, subject to the jurisdiction and dispute-resolution terms stated in the applicable agreement or invoice.
